Terms & Conditions

Welcome to Mila’s Gluten Free Bakery! These Terms & Conditions outline the rules and policies for placing and receiving orders from our bakery.

By placing an order, you agree to the following:

1. Orders & Payments

  • All orders must be paid in full at the time of purchase unless otherwise arranged.

  • We do not hold or reserve products without payment.

  • Custom orders may require additional lead time. Please contact us in advance to confirm availability.

  • Order Confirmation: Once your order is placed, a confirmation will be sent to the email address provided at checkout. If you do not receive an order confirmation within a few hours of placing your order, please contact us to verify that your order was successfully received.

  • We are not responsible for orders lost due to website technical issues. Customers should save confirmation emails as proof of purchase.

  • Order Modifications & Cancellations: Modifications or cancellations are only confirmed once you receive a reply from us. If you do not receive confirmation within 24 hours of your request, please follow up to ensure it was received.

  • Disputed Charges: Any disputed charges must be addressed in writing. Please contact us directly to resolve any issues before initiating a chargeback through your payment provider. We are committed to working with you to resolve concerns promptly and fairly.

  • Refund Processing: Approved refunds will be issued to the original payment method. Please allow 5–10 business days for the credit to appear, depending on your bank or credit card provider.

  • Chargebacks & Fraudulent Transactions: Chargebacks or fraudulent transactions may result in immediate service cancellation. We reserve the right to pursue legal action and seek recovery of any costs associated with fraudulent claims.

  • Product Availability: We reserve the right to adjust or substitute items of equal or greater value based on availability. We will notify you of any significant changes to your order whenever possible.

2. Cancellations & Refunds

  • Orders can be canceled up to 48 hours before the scheduled pickup or delivery time with no charge.

  • A 50% cancellation fee applies if canceled within the 48-hour window to cover preparation costs, ingredient sourcing, and scheduling. This fee will be deducted from any approved refund..

  • We do not offer refunds for missed pickups.

  • For orders of $500 or more, a 20% cancellation fee applies to cover preparation, scheduling, and ingredient sourcing. This fee will be deducted from any approved refund if the order is canceled in time.

3. Delivery & Pickup

  • We offer flat-rate delivery within select areas:

    • $15 flat fee for most locations

    • $10 flat fee in the 34787 zip code

    • Free delivery on orders of $100 or more

    • Free pickup is available in Winter Garden (zip 34787)

  • Orders are delivered on the selected delivery date, typically anytime before 6 PM.
    Specific delivery times are not guaranteed, as all products are made fresh to order. We recommend that someone be available to receive the order or that a sealed cooler be left out to help preserve quality and freshness.

  • Although all items are room temperature stable, we are not responsible for loss of quality due to unattended deliveries or environmental factors.

  • Please ensure all delivery details are accurate. Incorrect addresses may result in delivery delays or failed delivery.

  • Clients are responsible for ensuring that all delivery information provided at checkout is complete and accurate. This includes the correct guest name, resort name, and check-in date for hotel deliveries. Mila’s Gluten Free Bakery is not responsible for delays, failed deliveries, or order cancellations due to incorrect or incomplete details.

  • For the safety of our delivery team and the protection of your order, we ask that all delivery locations are accessible and safe.
    We cannot deliver to areas with:

  • Unsecured pets

  • Blocked access (e.g., locked gates or unmarked entrances)

  • Hazardous conditions

  • If we are unable to complete a delivery due to these circumstances, the order may be canceled without refund.

  • While our products do not require refrigeration, they are intended to be stored at room temperature. Exposure to high heat (such as in a car, direct sun, or outdoor conditions) may damage the product’s quality, texture, or appearance. Mila’s Gluten Free Bakery is not responsible for damage due to improper storage after pickup or delivery.

  • Hotel & Resort Delivery Timing: Even if a specific time slot is selected at checkout, deliveries to hotel or resort front desks will be made by 6:00 PM on your chosen delivery date.

  • If you have a specific time request, feel free to contact us in advance with your preferred delivery window—we’ll do our best to accommodate it whenever possible.

  • Hotel Coordination: While we work closely with resort staff to ensure smooth delivery, hotel policies, procedures, and timing may vary by location. Mila’s Gluten Free Bakery will coordinate all delivery details to the best of our ability. However, we are not responsible for delays, restrictions, or changes implemented by the hotel after the delivery has been completed. If the recipient refuses or fails to retrieve the delivered item, no refund will be issued.

  • Room Delivery: Some resorts may offer in-room delivery as a courtesy to their guests. This service is entirely determined by the hotel and cannot be arranged or guaranteed by Mila’s Gluten Free Bakery. Customers should check directly with their hotel regarding availability of this service.

  • Premium Orders: & In-Person Delivery: For specific custom or premium orders containing high-value items (such as gift cards), Mila’s Gluten Free Bakery may require an in-person delivery to ensure the safety and integrity of the order. In such cases, we will contact the customer in advance to arrange a mutually convenient delivery time.

  • After Delivery: Once your order has been delivered to the hotel front desk and a photo confirmation has been sent, Mila’s Gluten Free Bakery is no longer responsible for the condition or handling of the item. We are not liable for any loss, theft, or damage that occurs after delivery has been confirmed. Once the item is in the possession of the hotel or designated delivery location, responsibility for its care, storage, and condition transfers to the recipient or hotel. We recommend informing the recipient promptly so they can retrieve and enjoy their order as soon as possible.

  • Force Majeure (Unexpected Circumstances Beyond Our Control): Mila’s Gluten Free Bakery is not responsible for cancellations or delays caused by circumstances beyond our control. This includes but is not limited to weather disruptions, hotel restrictions, transportation delays, medical emergencies, or other unforeseen events that may impact the delivery or handling of your order.

  • During peak seasons (holidays, special events), extended lead times and modified policies may apply. Customers will be notified of any seasonal changes.

  • Orders must be placed by individuals 18 years or older, or with parental/guardian consent.

4. Allergens & Dietary Disclaimer

  • Our kitchen is strictly gluten-free. We do not use any ingredients that contain or may contain gluten.

  • We work with trusted suppliers, and while not all ingredients are labeled gluten-free, we verify with suppliers that their products are safe.

  • We do our best to use ingredients that are certified gluten-free and lab-tested to ensure the highest level of safety and peace of mind.

  • Please note that our kitchen also uses ingredients that may include nuts, dairy, eggs, soy, and other allergens.

  • We are not a certified allergen-free facility. Customers with severe allergies should use their own discretion.

  • Be sure to check the list of ingredients and allergen information provided with each product before ordering.

  • Mila’s Gluten Free Bakery is not responsible for errors, cross-contamination, or labeling inaccuracies on the part of our ingredient suppliers.

  • It is the buyer’s responsibility to communicate any allergen information to anyone who may be consuming the product.

5. Shelf Life & Storage Terms

Our baked goods are made without preservatives and are intended to be enjoyed fresh. By purchasing from Mila’s Gluten Free Bakery, you acknowledge the following:

  • Baked goods should be stored in an airtight container at room temperature and consumed within 3 days.

  • If refrigerated, items may retain freshness for up to 1 week.

  • For longer storage, items can be frozen for up to 2 months. Please note that freezing may slightly alter the texture of some cookies.

Proper storage is essential to maintain the quality, flavor, and texture of gluten-free baked items. Mila’s Gluten Free Bakery is not responsible for product quality concerns due to improper storage after delivery. 

Approximate Weight
All products are handmade in small batches, and while we do our best to ensure consistent sizing, slight variations in weight may occur.

​6. Liability Limitation

  • Mila's Gluten Free Bakery's total liability for any claim related to our products or services shall not exceed the purchase price of the specific order in question.

  • We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, or personal injury.

  • While we take great care in food preparation and handling, we cannot guarantee that our products will be free from all potential food safety risks. Customers consume our products at their own risk.

  • We are not responsible for adverse reactions, food poisoning, or other health issues that may arise from consumption of our products, except in cases of proven negligence on our part.

  • Our liability is limited to replacement of defective products or refund of the purchase price, at our sole discretion.

  • Any claims must be reported within 24 hours of pickup or delivery to be considered.

  • These limitations apply to the fullest extent permitted by law.

7. Custom Messages & Add-ons

  • A neatly designed message card may be included upon request. Customers can enter a short message at checkout, and we will print it in a clean, seasonal or branded layout to accompany the order. We reserve the right to omit messages that are inappropriate or exceed space limits.

8. Privacy & Website Use

  • Privacy Commitment: Your privacy matters to us. Mila’s Gluten Free Bakery only collects personal information—such as your name, contact details, and order information—for the purpose of processing your order, providing customer service, and improving our offerings.

  • Use of Information: Your data may be used to send order confirmations, delivery updates, important policy notices, or marketing messages if you’ve opted in. You can unsubscribe from promotional communications at any time.

  • Data Security: All payments are securely processed through a trusted third-party gateway. We do not store or handle credit card details on our servers.

  • Third-Party Services: We do not sell or share your personal information, except with select partners who help us fulfill orders or operate our website—and only under strict confidentiality agreements.

  • Legal Compliance: Your data may be released when required to comply with the law, enforce our policies, or protect our rights and safety, or that of others.

  • Consent: By using our services, you agree to the terms of our Privacy Policy and consent to receive email or text notifications related to your order and account. The full Privacy Policy is available on our website and may be updated periodically.

  • Digital Signature Consent: By checking the acknowledgment box during checkout, you consent to this Agreement electronically and agree that it is legally binding and has the same effect as a handwritten signature. You further agree to be bound by all terms of this Agreement, whether or not you have read them in full.

9. Website Content & Intellectual Property

  • All content on our website—including images, text, graphics, logos, and designs—is the property of Mila’s Gluten Free Bakery and protected under copyright and trademark laws.

  • Usage Guidelines:

  1. You may view and use content from our website for personal, non-commercial purposes only.

  2. You may not copy, modify, republish, or distribute any materials without our prior written consent.

  3. Using our website does not grant ownership or license to use any of our content beyond personal browsing.

10. Product Photography & Representation​

  • Actual products may vary slightly from photos shown due to the handmade nature of our baked goods.

  • Colors may appear different due to monitor settings and lighting conditions.

  • Product sizes and decorative details are approximate and may vary.

  • Custom orders will be made to match your specifications as closely as possible, but minor variations in appearance are normal.

  • Photos are for illustrative purposes and represent the general style and quality you can expect

  • Seasonal availability may affect certain decorative elements or ingredients shown in photos

11. Ingredient Substitutions

  • We reserve the right to make minor ingredient substitutions due to availability, while maintaining the same quality and dietary specifications

  • Major substitutions will be communicated to customers when possible

12. Weather/Environmental Factors

  • Extreme weather conditions may affect product appearance (humidity, temperature changes during transport)

Customization Accuracy

  • For custom decorations, colors, or text, final results may vary slightly from requested specifications due to the artistic nature of cake decorating.

13. Communication Policy

  • We’re available to assist you between 9:00 AM and 7:00 PM (EST). The best way to reach us is through the Contact Us form on our website.

  • We aim to respond to all inquiries within 24 hours. If you don’t hear from us within that time, please feel free to follow up to ensure your message was received.

14. Changes to These Terms: 

Mila’s Gluten Free Bakery reserves the right to update these terms as needed. The latest version will always be posted on this page.
